GENERAL TERMS AND CONDITIONS

Hereinafter referred to as: “Herself”.
These general terms and conditions apply to purchases made by consumers through the Herself webshop.
2. Applicability
- By placing an order, the consumer accepts these general terms and conditions.
- The general terms and conditions are made available before the order is placed and are provided to the consumer on a durable medium together with the order confirmation.
- The version of the general terms and conditions applicable is the version in force at the time the order is placed.
- If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The provision concerned shall be replaced by a valid provision that most closely reflects its purpose.
3. Offers and orders
- Herself makes every effort to ensure that product information, prices and images are displayed as completely and accurately as possible. Minor differences in colour, packaging or presentation may occur.
- The offer remains valid for as long as it is displayed on the webshop and while stocks last.
- Obvious errors, such as a clearly incorrect price, do not bind Herself.
- An order is definitively placed when the consumer confirms the order by clicking the order button indicating an obligation to pay and the payment has been successfully completed or confirmed.
- The consumer receives an order confirmation by email.
- Herself may refuse or cancel an order where there is a legitimate reason to do so, for example in the event of an obvious pricing error, suspected fraud, abnormal order quantities or where a product unexpectedly becomes unavailable. Any amounts already paid will be refunded in such cases.
4. Prices and payment
- All prices are expressed in euros and include VAT.
- Any delivery costs and other additional charges are clearly stated before the order is placed.
- The consumer pays the price displayed at the time of ordering, except in the event of obvious errors.
- Payment is made using the payment methods available on the webshop at the time of ordering. Herself may change these payment methods.
- An order will be processed once payment has been successfully completed or confirmed.
5. Delivery
- Herself delivers to the address or delivery location provided by the consumer when placing the order.
- Herself aims to deliver orders within the delivery period stated on the webshop. If no delivery period has been agreed, the statutory delivery period applies.
- If a product is temporarily unavailable or a delivery is delayed, the consumer will be informed as soon as possible.
- The risk of loss or damage passes to the consumer once the consumer or a third party designated by the consumer, other than the carrier, has physically taken possession of the product.
6. Subscriptions
- For certain products, the consumer may take out a subscription. The price and delivery frequency are clearly communicated before the subscription is concluded.
- The available delivery frequencies are those offered at the time of ordering, for example 6, 12 or 16 weeks.
- The subscription covers at least two delivery periods. From the third period onwards, the consumer may cancel the subscription free of charge.
- Cancellation can be made via the account portal or by email at team@naturalself.eu.
- Cancellation does not affect an order whose processing has already started, without prejudice to the statutory right of withdrawal or other mandatory statutory rights.
- If the subscription is automatically renewed, this will be clearly communicated before the subscription is concluded.
- Any price change for future subscription periods will be communicated to the consumer in advance. The consumer may cancel the subscription before the new price takes effect.
7. Right of withdrawal
- In principle, the consumer has the right to withdraw from the agreement without giving any reason within 14 days of receiving the product.
- To exercise the right of withdrawal, the consumer must inform Herself within this period by email at team@naturalself.eu. Use of the statutory withdrawal form is not mandatory.
- Following withdrawal, the consumer must return the product no later than within 14 days.
- The direct costs of returning the product are borne by the consumer, unless Herself has indicated otherwise or the law provides otherwise.
- In the event of a valid withdrawal, Herself will refund the payments received, excluding the cost of standard delivery.
- Herself may withhold the refund until the returned product has been correctly received or until the consumer has provided proof of return, where the package does not arrive.
- Upon receipt, the returned product will be inspected. If the product has diminished in value as a result of handling beyond what is necessary to assess its nature, characteristics and functioning, this loss in value may be deducted from the refund in accordance with the law.
- The right of withdrawal does not apply to sealed products which are not suitable for return for reasons of health protection or hygiene if the seal has been broken after delivery, provided that the statutory conditions for this exception are met.
8. Statutory guarantee
- Herself's products are covered by the statutory two-year legal guarantee of conformity from the date of delivery, in accordance with applicable legislation.
- This guarantee does not mean that a cosmetic product remains suitable for use for two years after opening. The consumer must always follow the expiry and usage instructions stated on the packaging, including the indicated period of use after opening.
- The statutory guarantee does not apply to problems that are solely the result of incorrect or abnormal use, improper storage, failure to follow the instructions for use or use beyond the indicated expiry or usage period, insofar as permitted by law.
- A lack of conformity must be reported to Herself as soon as possible and no later than two months after it is discovered, via team@naturalself.eu.
- The consumer retains all statutory rights available in the event of a lack of conformity.
9. Use of the products
- The consumer must use the products in accordance with the instructions for use, warnings and storage instructions stated on the packaging and/or webshop.
- Herself is not responsible for damage resulting solely from incorrect use, improper storage or failure to comply with these instructions, insofar as permitted by law.
10. Liability
- Herself is liable for damage that is the direct result of a failure attributable to Herself, insofar as such liability can legally be attributed to Herself.
- Nothing in these general terms and conditions limits the consumer's statutory rights or any liability that cannot be excluded or limited under mandatory law.
11. Force majeure
- Herself shall not be liable where the performance of its obligations is temporarily or permanently prevented by circumstances beyond its reasonable control, such as natural disasters, fire, war, government measures, strikes, serious transport disruptions, failures in energy or communication networks or problems with suppliers.
- If a force majeure situation means that an order cannot be fulfilled within a reasonable period, the consumer's statutory rights shall apply. Amounts already paid for products that have not been delivered will be refunded when the agreement is terminated.
12. Intellectual property
- All texts, images, logos, trademarks, designs and other content on the webshop are the property of Herself or are used with permission.
- This content may not be copied, distributed, modified or used commercially without prior written permission, except insofar as permitted by law.
13. Complaints
- Complaints can be submitted via team@naturalself.eu.
- Where possible, please include the order number, a description of the complaint and, where relevant, photographs of the product or packaging.
- Herself will handle complaints as quickly as possible and within a reasonable period.
- A complaint does not affect the consumer's statutory rights.
14. Applicable law
- These general terms and conditions and the agreements between Herself and the consumer are governed by Belgian law, without prejudice to mandatory consumer protection provisions applicable to the consumer.
- Herself and the consumer will first attempt to resolve any disputes amicably. If this is unsuccessful, the court with jurisdiction under the applicable statutory rules shall have jurisdiction.
